1. Thank you for visiting www.cea.gov.sg (this “Site”). This Site is the official website of the Council for Estate Agencies (hereinafter “CEA”). It is owned by CEA. This Site includes all CEA eServices and all CEA transactions and services, as the case may be, provided online.
2. By accessing and using any part of this Site, you unconditionally agree and accept to be bound by these Terms of Use. If you do not accept, or do not agree to be bound by these Terms of Use, please discontinue your access to this Site and do not use this Site.
3. CEA may amend these Terms of Use from time to time without prior notice. The amended Terms of Use will be posted on this Site, and upon accessing or using this Site after the amended Terms of Use have been posted, you shall be deemed to have accepted and agreed to be bound by the amended Terms of Use. All references in this Site to "Terms of Use" shall mean these Terms of Use as amended from time to time and posted on this Site.
4. In these Terms of Use, the following words shall have the meaning assigned to them except where the context otherwise requires:
"You" and "User" include the person who is currently accessing this Site whether or not using SingPass or otherwise including his/her principal where applicable.
"SingPass" includes the user ID/password authentication service.
Proprietary Rights and Restrictions on Use

The materials located on this Site (collectively known as the “Contents”) or any part thereof, including but not limited to information, logos, text, graphics, images, photographs, music, sound recordings, scripts, software programmes, technology, designs, data compilations, and other works are protected by copyright, trademark, and other forms of intellectual property rights. All titles to and rights and interest in the Contents are owned by or licensed to CEA.
6. Except as otherwise provided, the Contents or any part thereof, including the information on the Public Register of this Site, as the case may be, shall not be reproduced, published, uploaded, posted, displayed, copied, transmitted, used, reused or otherwise distributed in any way, without the prior written permission of CEA.
7. You may access and use this Site and the Contents or any part thereof in the manner permitted in these Terms of Use only.
8. You may view, use, download, print, hyperlink, copy, and distribute the Contents or any part thereof strictly and solely for personal, internal, non-commercial, non-business use, for personal information provided that you keep intact all accompanying copyright and other proprietary notices where applicable. You shall not commercially exploit the Contents or any part thereof in any manner whatsoever whether in Singapore or outside Singapore, or for any purpose that is for financial gain or for payment or other benefit or remuneration (whether monetary or otherwise) for yourself or for any third party with your consent (express or otherwise) or with your knowledge, as the case may be, in any way.

Except as expressly permitted by these Terms of Use, you shall not make or attempt to make any deletions, additions, adjustments, alterations, adaptations, or modifications to this Site or the Contents or any part thereof in any way without the prior written permission of CEA and (where relevant) CEA’s third party suppliers. You acknowledge and agree that any deletion, addition, adjustment, alteration, adaptation, or modification of this Site or the Contents or any part thereof is a violation of intellectual property rights subsisting therein owned by CEA or CEA’s third party suppliers. You agree and acknowledge that any use of the Contents or any part thereof otherwise than in accordance with these Terms of Use is a violation of intellectual property rights subsisting in the Contents and owned by CEA or CEA’s third party suppliers.
User's Responsibilities
10. You
• shall not use this Site and the Contents or any part thereof, as the case may be, SingPass or any other password for any unlawful or unauthorised purpose, as the case may be;
• are fully responsible for the security of the SingPass or any other password assigned to you;
• are fully responsible for all transactions and/or enquiries made through the use of your identification and/or SingPass or other password or otherwise, regardless of whether such transactions or enquiries were made with or without your knowledge and authority; and
• shall report to CEA immediately if you know or have reason to suspect that the security of your SingPass or any other password has been compromised or used by another person without your authority.
11. CEA reserves the right to block your SingPass or other password use without giving any reason whatsoever.
12. Where information is provided in this Site and the Contents or any part thereof, as the case may be, it is meant as a general information source only and should not be treated as CEA giving any form of legal or other professional advice, as the case may be. This Site and the Contents or any part thereof, as the case may be, may not cover all information available on a particular issue. Before relying on this Site and the Contents or any part thereof, as the case may be, you should do your own checks or obtain professional advice relevant to your particular circumstances.
Disclaimer of Warranties and Liability
13. Subject to the terms of our Privacy Policy in this Site, CEA will not disclose any personal information obtained from the User unless otherwise required by law.

15. CEA does not make any representations or warranties of any kind whatsoever in relation to the Contents or any part thereof, as the case may be, and hereby disclaims all expressed, implied, and/or statutory warranties of any kind to you or any third party, whether arising from usage, custom, trade, by operation of law or otherwise, including but not limited to any representations or warranties:
• as to the accuracy, completeness, correctness, reliability, currency, timeliness, non-infringement, title, merchantability, quality, or fitness for any particular purpose of the Contents or any part thereof, as the case may be; and
• that the Contents or any part thereof, as the case may be, available through this Site or any functions associated therewith will be uninterrupted or error-free, or that defects will be corrected or that this Site and the server is and will be free of all viruses and/or other malicious, destructive or corrupting code, programme or macro.

CEA shall also not be liable to you or any third party for any damage or loss of any kind whatsoever and howsoever caused, including but not limited to any direct or indirect, special or consequential damages, loss of income, revenue or profits, lost or damaged data, or damage to your computer, software, modem, telephone or any other property, whether arising directly or indirectly from –
• your access to or use of this Site and the Contents or any part thereof, as the case may be, the use of SingPass or any other password and/or in using, visiting or relying on any statements, opinions, representation or information on this Site and the Contents, as the case may be;
• any loss of access to your use of this Site, howsoever caused;
• any inaccuracy or incompleteness in, or errors or omissions in the transmission of the Contents or any part thereof, as the case may be;
• any delay or interruption in the transmission of the Contents of this Site, whether caused by delay or interruption in transmission over the internet or otherwise or malfunctions in equipment or software, howsoever caused; or
• any decision made or action taken by you or any third party in reliance upon the Contents or any part thereof, as the case may be,
for the conduct or the views of any persons who accesses or uses your SingPass or any other password and/or accesses or uses this Site and the Content or any part thereof, as the case may be, regardless of whether CEA has been advised of the possibility of such damage or loss.
Indemnity
17. You hereby agree to indemnify CEA and hold CEA harmless from and against any and all claims, losses, liabilities, costs, and expenses (including but not limited to legal costs and expenses on a full indemnity basis) made against or suffered or incurred by CEA arising directly or indirectly out of:
• your access to or use of this Site and the Contents or any part thereof, as the case may be; or
• your breach of any of these Terms of Use.
Availability and Right of Access
18. CEA makes no warranty that this Site and the Contents, as the case may be, will meet the User's needs or requirements, or that any service, software or information provided will be uninterrupted, timely, accurate, reliable, secure or error free.
19. CEA may at any time suspend the operation of this Site or all or the Contents or any part thereof for any period of time without any prior notice, whether for the purposes of website updating and upgrading, system maintenance, or otherwise.
20. CEA reserves the right to update or modify this Site from time to time. CEA further reserves all rights to deny or restrict access to this Site to any particular person, or to block access from a particular Internet address to this Site, at any time, without ascribing any reasons whatsoever.
21. You agree that you will not:

• use any device, software, or routine to interfere or attempt to interfere with the proper working of this Site; and

The User acknowledges, accepts, and assumes all risks inherent in Internet transactions and will not hold CEA liable under any circumstances whatsoever for any claim or demand (for damages, losses, expenses or otherwise) which the User may have or be exposed to as a result of the User assuming such risks.

If you do not agree to these Terms of Use, you shall immediately remove all frames of, and hyperlinks to, this Site or the Contents or any part thereof.

CEA reserves the right to remove or disable any hyperlinks to or any frames of this Site and the Contents, as the case may be, if those hyperlinks or frames are on websites containing material or information which, in CEA’s opinion, is profane, defamatory, obscene, indecent, offensive, inappropriate or otherwise objectionable, or violates any written law, policies, practice circulars and guidelines published by CEA or is otherwise unlawful, or is an infringement of CEA’s intellectual property or other proprietary rights.
28. CEA reserves the right to remove or disable any unauthorised hyperlinks to or any unauthorised frames of this Site and the Contents, as the case may be, appearing on any other website. CEA reserves the right to change any URL including the URL of this Site without notification.

Fees
33. Currently, no charge is imposed for accessing or using any part of this Site or the Contents or any part thereof. CEA reserves the right to introduce, from time to time, a charge for accessing or using this Site or the Contents or any part thereof, as the case may be. CEA is not responsible for any fees charged by any other website not operated by CEA.
Governing Law
34. Use of this Site or the Contents or any part thereof, SingPass or any other password and these Terms of Use are governed by the laws of Singapore. Any claim relating to use of this Site or the Contents or any part thereof, as the case may be, SingPass or any other password and these Terms of Use shall be heard by Singapore Courts.
35. These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore, and you agree to submit to the non-exclusive jurisdiction of the Singapore Courts.
