Suspension of 1 month and a financial penalty of $1,000 for a breach of paragraph 4(1) read with paragraph 4(2)(a) of the Code of Ethics and Professional Client Care, under the First Schedule of the Estate Agents (Estate Agency Work) Regulations 2010, for failing to ensure the following when advising her clients on the purchase of a Housing and Development Board property, in breach of paragraph 2.1.5 of the Professional Service Manual:

(i) That the properties referred to when advising her clients on property prices of similar properties were comparable to the property;
(ii) That information was provided on prices of recent transactions of similar or comparable properties in the vicinity; and
(iii) That the range and amount of data was reasonably comprehensive and that her clients were not misled on the value of the property.

c. Suspension of 2 months and a financial penalty of $3,000 for a breach of paragraph 5(1) of the Code of Ethics and Professional Client Care, under the First Schedule of the Estate Agents (Estate Agency Work) Regulations 2010, for failing to properly advise her clients on the type of property and floor area of a Housing and Development Board property; that the property was in fact a Model A Maisonette with floor area of 137 square metres and not an Executive Maisonette with a floor area of 148 square metres.

d. Suspension of 1 month and a financial penalty of $1,000 for a breach of paragraph 4(1) read with paragraph 4(2)(a) of the Code of Ethics and Professional Client Care, under the First Schedule of the Estate Agents (Estate Agency Work) Regulations 2010, for failing to procure a Title search for a Housing and Development Board property to verify the rightful legal owner of the property for purposes of advising her clients on the purchase of the property, and failing to give a copy of the Title search to her clients, in breach of paragraph 1.7.2 of the Professional Service Manual.

The suspension periods in (a) and (d) above were ordered to run concurrently.  The cumulative suspension period is 4 months, and to take effect from 7 August 2019, following the dismissal of her appeal to the Appeals Board.
